Terms of Use

Welcome to Crateful ("we," "our," or "us"). Crateful is a cloud-based service for hosting, managing, and distributing private Rust crate registries (the "Service"). By accessing or using our Service, you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, you may not use the Service.

Please read these Terms carefully. They contain important information regarding your legal rights, obligations, and available remedies.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to these Terms and represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

2. Definitions

• “User”: Any individual or entity that accesses or uses the Service.
• “Account”: The registered account required to access and use certain features of the Service.
• “Crates”: Rust packages, libraries, or modules uploaded or distributed via the Service.
• “Content”: All data, files, or materials uploaded, shared, or transmitted through the Service, including but not limited to Crates.

3. Account Registration and Security

1. Account Creation: To use the Service, you must register an Account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials.
2. Account Responsibility: You are solely responsible for all activity that occurs under your Account. Notify us immediately of any unauthorized access or use of your Account.
3. Eligibility: By using the Service, you represent and warrant that you are not located in a jurisdiction where use of the Service is prohibited by law.

4. License and Intellectual Property

1. License to Use the Service: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service in accordance with these Terms.
2. User Content:
   • You retain ownership of all intellectual property rights in your Crates and other Content uploaded to the Service.
   • By uploading Content, you grant us a worldwide, royalty-free, non-exclusive license to store, display, and distribute your Content as necessary to provide the Service.
3. Restrictions: You agree not to:
   • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
   • Use the Service to distribute malware, unauthorized Content, or illegal materials.
   • Circumvent any security measures or access restrictions in the Service.

5. Usage Restrictions and Prohibited Activities

By using the Service, you agree not to:

• Violate any applicable laws or regulations.
• Upload Content that infringes on the intellectual property or privacy rights of others.
• Use the Service for activities that are harmful, deceptive, or disruptive to others.
• Exceed usage limits or abuse the Service’s resources, such as bandwidth or storage.

We reserve the right to suspend or terminate your Account if you engage in any prohibited activities.

6. Fees and Payments

1. Service Fees: Certain features or tiers of the Service may require payment. All fees are detailed on the Service’s pricing page.
2. Payment Terms: Fees must be paid in advance for the applicable billing cycle. All payments are non-refundable except as required by law.
3. Taxes: You are responsible for any applicable taxes related to your use of the Service.

7. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

8. Service Availability and Changes

1. No Guarantee of Availability: We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation.
2. Modifications: We reserve the right to modify or discontinue the Service, temporarily or permanently, with or without notice.

9. Termination

1. Termination by You: You may terminate your Account at any time by discontinuing use of the Service and deleting your Account.
2. Termination by Us: We may suspend or terminate your Account if you violate these Terms, fail to pay applicable fees, or if your use of the Service poses a risk to others.
3. Effect of Termination: Upon termination, you will lose access to the Service, and your Content may be deleted.

10. Disclaimers and Limitation of Liability

1. Disclaimers: The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement.
2. Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Crateful, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, or liabilities arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of Ontario, Canada.

13. Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted on the Service, and your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
